Good Morning! After a day of rest, I am back and ready to face the world. Again thank you for coming to the shindig, on Saturday. Mala -- you were so very missed.

it was really nice to escape from the daily dose of dystopian doodoo. For one day we lived in a liberal utopia.

So Let's get this week started, shall we?

Yeah uhhhh, I don't think that's how it works. In fact, there's clear judicial precedent to the contrary - that if a decision affects the Congress and Executive it also affects the state legislatures and governors. So yeah, that would be destroying stare decisis too.

I am waiting on exterminators due to an ongoing ant problem.

I have someone on my Facebook page who is arguing that the Nazis were socialists. Feel free to chime in.

I spent the first week of vacation cleaning and getting some applications out.

I will check on some jobs in Chicago, Los Angeles, and Boston. I like many of the people I work with at my school, but I seem to have gone from one political environment to another.

Today's decisions at the SCOTUS...

US v. Davis (Gorsuch, 5-4) : Question of whether the phrase "crime of violence" is too vague. Kavanaugh has a pretty vigorous dissent.

Food Marketing in Argus Leader Media (Gorsuch, 6-3): Freedom of Information Act case involving potential disclosure of private company information via the USDA SNAP program. Breyer had an interesting dissent, in which he's arguing that in some instances the information is needed to protect consumers.

Iancu v. Brunetti (Kagan, not sure of the split): Can the acronym FUCT be trademarked? The answer is yes. The split on this one is really odd - six sign onto the main decision, and there's three secondary opinions that concur or are half & half. I suppose that means in some sense it's unanimous.

Dutra Group v. Batterton (Alito, 6-3): Questions about punitive damages regarding bodily harm caused by the condition of sea-going vessels. Ginsburg gives the dissent here.
