Investigation Theater

I little while back, I wrote a blog about how a faction of House Republicans wrote up articles of impeachment - not to impeach pResident tRump, but Deputy Attorney General Rod Rosenstein. That was squashed by House leadership. The initial impression was that we thought that it would be bad publicity for them right before the mid-term elections. The rationale, it appears, is much darker.

Besides the Mueller investigation , the House has also been investigating whether anything illegal occurred during the presidential campaign between tRump and the Russians. On the surface (based on what we normal citizens have access to), it has become increasingly clear that the campaign definitely did. What's still not clear is how much did tRump know and when did he know it. The head of that investigation is Devin Nunes (R-CA). He has come across as someone who appears to be doing everything he can to help tRump, rather than conduct the investigation in a fair and unbiased way.

There is now evidence that he is definitely interfering in his own investigation and attempting to use the power of the Congress to help impede the Mueller investigation as well. Last night, the Rachell Maddow Show aired audio that was surreptiously recorded at a fundraiser for Rep. Cathy McMorris Rodgers (R-WA) just over a week ago. This is the entire thing:



If you don't want to spend the 10 minutes watching the entire thing, here are the most damning parts of it:

06:30 - Nunes admits that using stolen docs is a criminal act: This is where he actually concedes that what the tRump campaign did (using documents stolen from the DNC by Russian hackers) would indeed be a criminal act. This undoes any argument that Republicans and tRump cultists may use that this wasn't investigation-worthy. The person in charge of this investigation is on tape saying that it's illegal.

13:15 - Explains why they don't want to impeach Rosenstein right now: the reason they don't want to impeach Rosenstein right now is because they don't want to distract the Senate from confirming Brett Kavanaugh to the Supreme Court. They don't think the Senate can do both, and the SCOTUS pick is their priority. I think they all know that the Dems could take control of the House and/or Senate after the election, and then their opportunities evaporate. It also seems obvious why they want that SCOTUS pick - that action will result in a long-term shift in the court that will still exist long after tRump is gone. There's also another reason...

17:45 - Describes how they (House Republicans) are the only ones who can protect tRump (disrupt the investigation): Nunes is admitting that they (House Republicans) are actively trying to protect tRump from the Mueller investigation, even as they are pretending to also be investigating tRump. If Rosenstein is impeached before Kavanaugh is confirmed, there could be a constitutional crisis that would require action from the Supreme Court. Without Kavanaugh, they could lose that one. If he's there, though, that would be a win-win for them.

And that - in the end - is the crux of it all. Nunes continues to put on this investigation theater, stalling for time until they can get their preferred Supreme Court pick installed, and then they can proceed with shutting down any further investigation of tRump, confident that the courts will ultimately back them up. It's cynical, devious, and disgusting.

Contact your House Rep, and demand that Nunes be removed from the investigation immediately. He also needs to be investigated by the Ethics House Committee
