AT&T Could Owe You $146,000
FISA violation means $36,500 per claimant, per four years of wiretapping

The Legality Blog has an interesting read on just how much telecom providers like AT&T could owe their customers should the lawsuit against them for illegal wiretapping be allowed to proceed. While there are more than forty potential suits currently open against Sprint, Verizon and AT&T, the EFF's case against AT&T is the most highly visible, given it involved a 22-year former employee turned whistleblower. If the EFF case proceeds and it shows widespread violation of FISA laws, AT&T would be in some serious financial trouble:
Code provision 50 U.S.C. § 1810 imposes civil liability on any person (or entity) for each violation of FISA. Victims of illegal surveillance are entitled to recover $100 for each day they were wiretapped, or actual damages over $1000, whichever is greater. Additionally, FISA provides compensation for attorney’s fees and other costs of litigation. . . As you may imagine, one hundred dollars per day, per person adds up over four years. If the Hepting lawsuit is successful, AT&T could face damages of over $36,500 per claimant per year. Nearly every person with a computer or phone in the United States could be impacted.

AT&T serves 14.2 million broadband customers and roughly 70 million landline users. If they were forced to pay $146,000 to each landline customer, AT&T could be facing a total legal liability cost of $10,220,000,000,000.
This is what the Telco immunity is all about. NOT our Security. There is the dirty little secret.

Guess what Else? FISA and Telco Immunity isn't dead. The Vote could very well happen today, SO I urge everyone to go out there and make those phone calls. Tell your Representatives that you know the real deal. Tell them to say NO TO IMMUNITY.
Every one of these Telecom companies will end up singing like a Canary because they certainly won't want to be the ones that actually have to face these fines. The Federal Government under the Bush Administration MADE THEM DO IT.
(And please, do not forget the fact that this all started before 911™... )

It's Thursday. I am sure it will be another wild and wooly day of Kitchen Sinks Flying around, So watch out and don't be afraid to duck and cover.

Is it wrong for me to dislike Sen. Clinton? I'm really starting to think she would be more of the same...in bed with big business, power hungry, megalomaniac, and now she's starting to play dirty just like the Repugs.



I keep hearing more and more that Bill Clinton was the best Republican president we've ever had, do we really want more of that with Hillary?



Obama has his flaws too, don't get me wrong....but if we really want something different, he's the one. Hillary represents the status quo to me, and we've all had enough of that.

Good morning.



My older cat, Sandi, had a rough day yesterday. I accidentally shut her in a closet before I left for work. Usually they both are in the front room when I leave, but I was in a hurry and I didn't have time to investigate when I noticed they weren't there.



Poor Sandi! She was trapped there from 7:30AM until after 5:30PM. :(



I feel like such a bad mom.



And in the process, since of course she had to relieve her bladder, one silk dress and one silk kimono got "marked." I've found only one place locally that's willing to try to save them.



And just to put the icing on the cake, I was having some friends over for dinner and apartment decorating. Needless to say, dinner was late.....



Sandi was still so shook that she wouldn't even come to bed with me last night - the same room where the closet is.



I made damn sure I knew where both of them were before leaving today!

Funny that you mention this. Yesterday I noticed that Camille was outside for MUCH longer than usual. I try not to sweat it since she used to be outside for 12 hours or more at a time, back when I was in NY. But Bob and I decided to take a quick peek for her. She was in the neighbors yard, and she would come when called, altho I could hear her shuffling around (she doesn't really meow)



Turns out this silly feline somehow got her front paw stuck in her collar.... I don't know how long she was there, and yeah I felt bad.



She was so glad to be carried back home. She ate some Ice cream and went right to sleep.

Said former girlfriend used to keep some of her shirts in the spare bedroom armoire, and she often got dressed while it was still dark in the morning. Parker Posey, one morning, somehow slipped into the shirt drawer when former girlfriend wasn't looking.

I got home from work and after about 10 minutes, I said "Where's Parker?" Former girlfriend had not noticed that she hadn't seen her since she got home from work.

We looked everywhere and then we heard this faint "meow meow." She had been stuck IN A DRAWER all day!!!

Poor kitty! Part of the reason I couldn't find Sandi right away after work is that her meow is *so* quiet and high-pitched. I went into the bedroom several times, scouring every corner to see if she was hurt or sick or (we won't say that bad word right now....). I was terrified she'd somehow slipped out when I left for work.



Flashback to Christmas 2002 - Sandi and I were heading back to Pittsburgh for the holiday. I wasn't in the habit of putting her in a carrier - she had a harness, but I tended to let her roam around the car.

The first pitstop, I came back to the car and she was nowhere to be found. I still can't even talk or write about it without tears in my eyes. Long and short - she had managed to squeeze from the back seat into the trunk (it was a hatchback). It was at least twenty minutes before I'd calmed down enough to drive again.



I always flash back to that time when I can't find her - the thought of losing her without knowing where she is or what's happened to her gives me the most paralyzing feeling I've ever known.

Good morning all! And Starling! I've been wondering where you were.



We had a Maine Coon cat that used to hang out in the back yard only. She was a big time hunter and would stalk a gopher or mole for hours. She also went after baby black birds because their parents were always bothering her. That was the icky part. Any hoo, one day she did leave the back yard and we searched for her for three days. It was the saddest three days. Late on the third day, she came home covered in pine tree sap and skinny as a rail. Evidently she had run up a tree and couldn't get down. She was quite the talker and we heard about it for days, especially when we were trying to de-sap her. Sweet kitty except when she was in a mood.

This is one of the REALLY bad cancers. I know tha tpeople will tell me that all are bad, but Pancreatic Cancer is truly brutal. I wish him the best.

I got angry at that guy who said that Obama only won country bumkin states. I found that really arrogant.



Having lived in NY, a closed primary state and Now Georgia, I have to say Obama winning here is pretty big. Besides, I find it VERY offensive that people seem to think that a vote in say, Alabama is less than a vote in California.



One more reason to have a national primary Day I guess. You cannot discount Hillary or Barack becuase of the states they have won or lost. it is all about the delegates in the end.



And EITHER way... if we are REALLY dems , we would never use the wins as a way to discount the fact that people are getting out and voting... THAT is the most important thing ever.



TOO FEW americans vote. We should never discount those that get up and vote in a primary.

Hillary's campaign also argues that there are 20 years of her tax returns already released to the public. Well, yes - from 1980 to 2000. It's now 2008. We don't get to see the last 8 years? One more thing. This of course now means that Hillary was the one acting like Kenn Starr when she demanded that Lazio release his returns.

I'd be happy to supply some of the documents from the case... Essentially, the Court has told the Bush Administration attorneys that their arguments re: if we tell you all the truth, we'll all die, are bulls*&t. And while the case itself may only be for civil damages, the information gained in discovery just might lead to criminal liability. And the Ninth Circuit is one that just might have the balls to let the case go forward. UNLESS the new FISA act stops it in its tracks with Telcom immunity...

Haven't decided which one to grab yet. I could go tradional "box" wine and get the Delicato Bota Box - which has gotten some good reviews. Or I could go, 500ml juice bag style with French Rabbit.



I'll leave the Pebble Creek in the warehouse though - that stuffs for cooking with I think.

The vote was about having paper ballots and from everything that I have understood the DEMS agreed to having the Primaries moved up in the same bill. IT was added to the same bill!

The dems agreed to that. So I think it is safe to say that EVERYONE can be blamed.



bottom line:



We NEED TO GET A FILLIBUSTER PROOF HOUSE AND SENATE.



No president in the world can change anything if we can overcome a fillibuster.

Lessee...looks like the Dow started the year around 13,400. It finished today at 12, 047.



So it's down 1300 points on the year (give or take) or about 1%.



The 52-week high was 14,279, so it's down 2200 points from there, or 1.5%.



Over the same 52-week span, oil went from around $60/bbl to today's close at $102.70, an increase of around 80%, if my math is right.



Oil was in the mid-30s when we started this whole escapade in Iraq...
