If the Army tries to court-martial 1st Lt. Ehren Watada a second time, it cannot prosecute him for refusing to deploy to Iraq, a federal judge ruled Tuesday.
Seeking a conviction on that charge -- the most serious that Watada faced -- would constitute double jeopardy, U.S. District Judge Benjamin Settle in Tacoma decided.
Settle agreed with Watada's request by throwing out the charge of missing movement for refusing to deploy with his Fort Lewis-based Stryker Brigade to Iraq in June 2006. Watada said the war was illegal.
Settle also dismissed two specifications of a second charge, of conduct unbecoming an officer, related to statements Watada made against the war and against President Bush. He made the statements at a news conference and in a speech at a Veterans for Peace convention.
If he had been tried and convicted on all charges, Watada would have faced the potential of a six-year prison sentence and a dishonorable discharge.
The judge did not toss out two other specifications of conduct unbecoming an officer that concern interviews Watada gave. Army prosecutors had dropped those specifications before the court-martial.
A military court will have decide whether to pursue those charges.
James Lobsenz, one of Watada's attorneys, said his client is pleased with Tuesday's ruling. Calls by the Seattle P-I to officials at Fort Lewis were not returned.
"We're happy, but it's too early to know what else might happen," Lobsenz said. "It's highly likely (the Army) will appeal the judge's decision."
It is unclear what will happen next, but Lobsenz said he is confident that his client has a strong case should the Army continue to pursue another trial.
Watada became a cause célèbre for the national anti-war movement more than two years ago when he said he would not go to Iraq.
He was the first U.S. military officer to publicly refuse deployment.
Watada's first trial, in February 2007, ended in a mistrial despite his objections.
The military judge, Lt. Col. John Head, declared the mistrial after ruling that Watada did not fully understand a stipulation he had signed before the trial.
After a series of postponements, Watada's attorneys went to the civilian U.S. District Court, arguing that a new court-martial would violate constitutional protections against double jeopardy.
Settle granted a preliminary injunction against a second court-martial in 2007.

He used to listen to Larry King's overnight radio show every morning - this was way back in the mid 80s when he was still working (he went on disability for this progressive brain/ear disease that causes vertigo). For the past two months, a major American magazine and an allied news service have been engaged in a legal battle with the United States Navy over records that they believe show that John McCain once was involved in an automobile accident that injured or, perhaps, killed another individual.
Vanity Fair magazine and the National Security News Service claim to have knowledge "developed from first-hand sources" of a car crash that involved then-Lt. McCain at the main gate of a Virginia naval base in 1964, according to legal filings. The incident has been largely, if not entirely, kept from the public. And in documents suing the Navy to release pertinent information, lawyers for the NS News Service allege that a cover-up may be at play.
"Plaintiffs have also obtained documents showing that law enforcement officers were ordered back to the accident scene to retrieve personal physical effects. The Navy has never publicly acknowledged this information," one document reads. "This request involves federal government activity, as it addresses what may be an attempt by the Navy to protect by concealment the involvement of a former Navy officer, sitting Senator and Presidential candidate in a serious incident involving the injury or death of another human being."

A ruling by Virginia's attorney general today paved the way for dozens of potentially invalid absentee ballots mailed from overseas to be counted in the Nov. 4 election, ending a controversy that some feared would disenfranchise members of the military.
Republicans last week blasted the Fairfax County general registrar, who said about 100 federal write-in absentee ballots, often used by members of the military serving abroad, were invalid because they did not have a witness's address, as required by state law.
In his ruling today, Attorney General McDonnell ® said that federal law trumped state law, and that the ballots should be counted. The ballots are used as backups by citizens abroad who fear that the absentee ballot mailed from their locality won't reach them in time.
The Virginia Code states that voters who had not previously applied for a local absentee ballot must have the federal ballot signed by a witness, who also must provide his or her address. Although the online instructions for the ballot say a witness must provide his or her address, the ballot doesn't expressly state that requirement, and many don't include their address. In denying the federal ballots, Rokey W. Suleman II, the Fairfax registrar, said he was merely following state law.
"I can't ignore the law," Suleman said last week. "Believe me, if I could get a lawyer to tell me to allow these votes, I'd love to."

At work, we have been subjected to a similar show , "Daddy's Spoiled Little Girl" where the father is preparing for the daughter's big birthday/moving/graduation party and the cost of these shindigs is usually more than I make in a year which is often combined with the expensive shopping spree. Daddy buys the 17-year old daughter a high-end SUV right off the lot while I settled for my dad's 1976 Nova as a hand-me down for my first car.

At work, we have been subjected to a similar show , "Daddy's Spoiled Little Girl" where the father is preparing for the daughter's big birthday/moving/graduation party and the cost of these shindigs is usually more than I make in a year which is often combined with the expensive shopping spree. Daddy buys the 17-year old daughter a high-end SUV right off the lot while I settled for my dad's 1976 Nova as a hand-me down for my first car.
That sounds like that Sweet 16 show. I could only watch about 10 minutes of about 3 shows. It made me want to bitch-slap the whole family.
