Constitution Redux... further musings

Last Saturday, TriSec posted a muse on the U.S. Constitution. I'd like to provide a "part II", and continue along the same lines, discussing some bits that I find interesting as well.

From Article 1, Section 8:
To regulate commerce with foreign nations, and among the several states...
To coin money, regulate the value thereof, and of foreign coin...
To provide for the punishment of counterfeiting the securities and current coin of the United States...
To define and punish piracies and felonies committed on the high seas, and offenses against the law of nations...
This sounds to me that Congress is given most of the foreign relations power. Yet we seem to often expect that power to reside in the presidency. In fact, the whole "foreign policy" experience issue seems to be the number one talking point this election cycle, even though the President is not granted any specific powers in that area.

Again, from Article 1, Section 8:
To raise and support armies, but no appropriation of money to that use shall be for a longer term than two years;
To provide and maintain a navy;
So the Congress is granted the power to raise an army and maintain a navy. To me it seems pretty clear that maintaining an army is unconstitutional. It also points out that Congress needs to redo the spending bills for the military at least every two years, so it's in their power to keep that from spiraling out of control. They certainly haven't done much of that controlling over the last 7 years.

Once more from Article 1, Section 8:
To provide for calling forth the militia to execute the laws of the union, suppress insurrections and repel invasions;

To provide for organizing, arming, and disciplining, the militia, and for governing such part of them as may be employed in the service of the United States, reserving to the states respectively, the appointment of the officers, and the authority of training the militia according to the discipline prescribed by Congress;
Compare that to the 2nd Amendment:
A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.

It seems to be even more clear that the whole "well regulated militia" part of the second amendment is key to this. This is NOT a blanket "everyone can own a gun" declaration; it is clearly a description of our modern National Guard, with the idea that the Guard would provide for the defense of the country, and would defend the people from the government should the need arise.

Finally, apropos of another important news item, from Article 1, Section 9:
No bill of attainder or ex post facto Law shall be passed.

"ex post facto Law" means any retroactive law, such as say - granting retroactive immunity to the telecoms? Once again the Bush Administration and its cronies are pushing for a law that is patently unconstitutional.

Despite being 200 yrs old, the U.S. Constitution is an amazing document, and despite the anachronistic linguistic stylings and verbiage, is not that hard to read and comprehend. I recommend it to everyone.

Excellent post BobR. I too am awed by our Constitution. It may not be absolutely perfect, but it has served us well............... up until our current criminals.



I am still angry and confused why we cannot impeach these guys for their crimes!



I'm not sure about the 2nd Amendment, I do believe it refers to our "national guard" (well regulated militia) but I am frankly glad that we - us common folk - are able to own guns. We may one day need to protect ourselves from "ourselves".



BTW: if anyone wants a copy of the constitution, Dennis Kucinich is giving out autographed copies of the small version that he carries on him, for a contribution. He is desperate for funds!!

Since it seems as if the Telcom immunity provision is a violation of the constitution under the prohibition of ex post facto laws, why hasn't the opposition brought it up and only a little blog seems to have noticed this little detail?

Anybody know whether they voted yesterday on the telecom immunity provision of the FISA Bill (I think it was up in the House, perhaps debated in the Senate?)? Just so you all know today the Supremes will hear the Exxon Valdez case - whether the 24,000 (out of the original 30,000 - 6000 of the original claimants have died) Native fishermen and other Alaskans wil ever see the $2.5 billion that a court granted them over 14 years ago... I sure do hope that they get what they have coming to them .

Hallo all



My car had currently taken up residence at my mechanic's garagee, my current temporary boss is interviewing people (I had been told I would be interviewed, but since no one seems to have scheduled me, I'm not crying pools of tears - the attitude of some of the doctors towards the people who support them is abominable), the DL Pittsburgh party last night went fantastically, I've been fortunate enough to have hitched rides with kind souls and something's brewing today that bodes well for me.



Now, if I could only work on the frickin' dictation that's been foisted on me for some unconscionable reason. There are four tapes sitting waiting for me but the headset is *so* painful I hate to have to use it.

We have a do nothing BOD for an HOA, especailly when it comes to me. It's still being headed up by the not so nice "reverand" who hates me.



We diffenetly think it's being rented to more then one family at a time. There are times when people overlap there time there.



There is a Overcrowding Complaint line, but so far it's not over crowding it's just running the place down. Mom wants to report them to the "save Manassas" group but I think that's just nothing but a bunch of racists and I won't do it.



I just don't know how to handle the situation.

They aren't disturbing the peace, expect when moving.



It's not been the same people so I never know who I've met and who I haven't. Can't really hold lengthy conversations with them, don't know that they have that much English under their belts. Other then that the people I have met seem nice. We exchanges good mornings/evening and hellos.

That is something I see about people on the right. the worst they are treated like ABOVE them the better they love them. And sense they can't be mad at then they treat others like shit.

Not really sure, I never see boxes. Just beds and stuffed black trash bags which always seems weird to me. I mean a pair of suitcases at Target's only about $60 and would be much better for their stuff then a Hefty

Mala, In your area, are you allowed to sublet out homes? I see where you are going with this and I unserstand the trepidation. HOWEVER, if it is a transit house, I think that is a serious problem. being that you can only suppose, I thik that it might be better for you to try to find some kind of group that can assist you in thisissue. PErhaps there is a non prfit that actually helps people who may be undocumented in your area. You may want to contact them as opposed to this racist group you mentioned and express your concerns.

if it is a tranist house, I fear there may be more things going on there that go way beyond the fact that they are mexican. it isn't about being mexican or even possibly being undocumented, it is about trafficking people.

Around here they would more then likely be El Salvadorian. I understand what your saying though.



I was searching on the cities website and found something called Neighborhood Services, they say there mission statement is to foster good community relations. I think I might start there and see what they say.

IT makes perfect sense to me Mala. More people need to participate in thier communities. And in doing so it does reflect on our own homes.



I could not care less who lives next door to me if I know that they are participating and not breaking the law. I have been having a similar situation with a house next door to me. IT is one of those infill houses -- IE a McMansion. (ugly as all hell)



The man has not followed our watering restrictions(at one point he was stealing our water having the workers come into our yard and fill 5 gallon buckets and then by putting the hose over the fence!) has claimed the property I rent partly is his, he has tried to tear down trees that is against the law, it has been awful. Each time I questioned him, he has treatened to take me to court and sue me. IT has been very nasty. Just the other day I saw him trying to tear down a tree with a truck and a rope. I asked him if he had a permit to do that (after he asked me from his yard why I was looking at him and that is should not look and mind my own business -- for the record, I was talking to my apt. neighbor at the time) Any way, he said it was none of my business to question what he does on his own property.. Guess what?



It is my business when I see people breaking the law. I may be a gladys kravitz, but I don't care. Too long I have seem the effects of people doing nothing.

I could not care less who lives next door to me if I know that they are participating and not breaking the law. I have been having a similar situation with a house next door to me. IT is one of those infill houses -- IE a McMansion. (ugly as all hell)

Gawd! He must be related by my back yard neighbor who treats the common areas as his own personal dirt bike track. The noise and smell is horrible, some days I can't even sit in the back yard, and they've destroyed the grass in that area. When I asked them to go somewhere else cause it was so loud and the gas fumes were getting into my home they told me to go to hell.

From his website, at least...it still looks like a viable campaign. I checked myself yesterday, he has not moved towards dropping out. I have no information on any challenge he may be facing for his seat in Texas.

Ah, I've long given up my "live and let live" attitude in my neighborhood. If you're pissing me off, damn right I'm calling you on it. But that's just me. I just had a neighbor's truck towed because he was parking it illegally and it was leaking oil.



I'm Home Properties worst nightmare, a long-term resident that remembers what the neighborhood was before they came.

You are right. I should have wrote "he at least acted better in his latter years than some of his heirs in the conservative movement. You could hold a civil discussion with Buckley that you could never have with Michael Savage."



The conservative movement may outlive Buckley, but it had everything - the White House, the Senate, and the House of Representatives - and seems to have produced NOTHING of lasting value to most Americans.

Say, I never updated everyone on my round 2 interview yesterday...



This was with the hiring director (there's two other managers I could meet with yet.)



I think this one was far more substantive than when I met the VP; I tried really hard to play up my training and documentation skills, which are going to be badly needed up there. I'm also glad that I have close contacts with folks on one of the teams that's moving up there. I trained one of them when she was hired last year, so I have more than a passing familiarity with the ops that are moving to Maine...



Still waiting to hear back on next steps. But this is still on track!



(Mrs. TriSec still needs to drink the kool-aid, though. She's only watched me mix it but hasn't tried any yet.)
