Supreme Disappointment

The Supreme Court has been busy the last few days. It's that time of year when these 9 don their robes, listen to arguments, then write opinions based on their own personal... opinions. When the stars align correctly (such as Rowe -vs- Wade), these decisions grant individuals more rights, more freedoms, and more protection. Lately though, the decisions have been swinging the other way.

A few days ago, they decided that the $2.5 billion in damages awarded by a lower court to be split among some 32,000 plaintiffs needed to be reduced to about $507.5 million. Their rationale?:
The court's majority found that Exxon had acted without "intentional or malicious conduct," and a 1-to-1 ratio of punitive to compensatory damages "is a fair upper limit in such maritime cases," according to the decision penned by Justice David Souter.

Plaintiffs said the court failed to take into account the damages that never were compensated in the first place, due to the quirks of maritime law and the long years it took for environmental impacts to manifest themselves.

I wonder if there's any precedent in law for a "1-1 ratio"? That seems VERY arbitrary...

The SCOTUS also struck down the so-called "Millionaire's Amendment" portion of the McCain-Fiengold campaign finance reform law, saying it's unconstitutional because it violates the 1st Amendment of the Constitution. The idea was to level the playing field for poor candidates campaigning against wealthy candidates that use his/her own money by raising the caps on contributions. The upshot of this is that our government will be of the rich, for the rich, and by the rich. One can only hope they have some cake with which to feed us...

Another controversial ruling involves the death penalty and child rape. The court struck down the death penalty for any crime other than one that results in a death. Certain crimes are so outrageous and disgusting that the emotional response is to string the scumbag up by his balls and leave him there to die (be honest - what were you thinking about that Austrian guy that kept his daughter locked up in the basesment for his own personal rape toy?). Naturally, this ruling has plenty of people voicing their opinions, including Barack Obama:
When asked about Supreme Court ruling against the use of the death penalty in instances of child rape today at a news conference in Chicago, Obama answered, “I disagree with the decision. I have said repeatedly that I think that the death penalty should be applied in very narrow circumstances for most egregious of crimes. I think that the rape of a small child, six or eight years old is a heinous crime, and if a state makes a decision that under narrow, limited, well-defined circumstances, the death penalty is at least potentially applicable. That does not violate our constitution.”

He continued, “Had the Supreme Court said, ‘We want to constrain ability of states to do this to make sure that it's done in a careful and appropriate way,’ that would've been one thing, but it basically had a blanket prohibition and I disagree with that decision.”

That should produce some very mixed feelings in the typical pro-Obama/anti-death penalty people...

The most notorious of the rulings though, was the willful misinterpretation of the 2nd Ammendment. In shooting down the DC gun ban, the court has opened a whole new can of worms:
By 5-4, the court struck down the District of Columbia’s strict gun ban as an infringement on fundamental rights. The court’s historic ruling reinterprets the Second Amendment for the first time in nearly 70 years, foreshadowing new challenges to local, state and federal gun laws.

Scalia in particular, decided to parse the 2nd Ammendment at every comma:
"The Second Amendment protects an individual right to protect a firearm unconnected with service in a militia and to use that arm for traditionally lawful proposes, such as self-defense within the home,” Justice Antonin Scalia wrote for the majority.

... and then immediately contradicted himself:
“Like most rights, the Second Amendment right is not unlimited,” Scalia wrote. “It is not a right to keep and carry any weapon whatsoever in any manner whatsoever and for whatever purpose.”

Let's take a look at that exact wording, shall we?
A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.

Seems to me that being a member of a well-regulated militia IS specified, while limiting certain types of weaponry is not. What the hell was he reading??

Of all the SCOTUS justices that need to retire (IMO), Scalia is at the top of the list. He doesn't try to hide his bias and how they affect his decisions. He recently blamed Al Gore for the 2000 election mess:
"Richard Nixon, when he lost to [John F.] Kennedy thought that the election had been stolen in Chicago, which was very likely true with the system at the time," Justice Antonin Scalia told The Telegraph.

"But he did not even think about bringing a court challenge. That was his prerogative. So you know if you don't like it, don't blame it on me.

"I didn't bring it into the courts. Mr Gore brought it into the courts.

The 2000 election case and the recent DC gun ownership case seem to be appropriate bookends to his time in the SCOTUS during the Bush Administration that saw Scalia and Cheney going on a hunting trip together. Justice is supposed to be blind. Justices, on the other hand, should not be blind to their own predjudices and political leanings. They should overcome them in defference to the law, not the other way around.

More than the environment, more than the Iraq War, more than the economy, the replacement of judges on the SCOTUS is the most important issue of the upcoming election. Let these recent decisions be an important reminder of that.

1. Ya know that 2.5B going to 32,000 would have giving each of those people 7Mil if I did my math right. When it comes to awarding damages 7mil for the person hurt was not a crazy out of control number.



2. The DC Gun Ban was struck down cause some paranoid middle aged white guys are scared and don't like that they are pretty much in the minority in DC.

Scalia is not an impartial judge and rules through his bias. His son was also working the Bush side in Bush v. Gore which means he had a stake in the outcome. He should be impeached for violating judicial ethics.

Obama has many interesting things to recommend him, but that tidbit about him holding a degree in Constitutional Law and being a scholar of said Constitution really speaks volumes to me about his motivation.



After "It's just a damn piece of paper", to have the next occupant of the oval office be as professionally reverent about it as us lay people is going to be quite a change.

I can't blame Momma and the Mooks for wanting to take it easy. We have been on a rollercoaster for a long time in terms of the news.



As for the Supreme Court, I think that we should have evidence that there is a need to make sure that there is a chance to have more reasonable justices than Scalia appointed to the bench. (Mike Malloy seems to be doubtful about Obama and the Democrats appointing anyone more liberal than John Roberts because of fear of the Republicans.)

It looks like the Supremes took pity on poor picked-on Exxon. I mean, that $2bn would really, really hurt them. Their strategy worked perfectly - stall, stall and stall until most of the plaintiffs died off and they got a court system rigged in their favor.



Think of their profits when gas is $7/gal in 2010 like it's being predicted.

I heard yesterday that 23 percent of Hillary supports (and I say that mildly) are now supporting John McCain, I have said it before and I will say it again... they were NEVER dems. They are Republicans for hillary. Always were.

OK, I just talked to the insurance guy and my car's value is so low I wouldn't even get enough money for a deposit so getting another car is kind of out of the option. I may just have to replace the mirror that came off and live with the damage until I get enough money (or hit the jackpot).



Since I'm going to Vegas next month for vacation I could use some lucky vibes from anyone who thinks they can give me luck because I sure need it.

Liv - at least the car is driveable. Had to replace my side mirror once only cost like $50 so it wasn't too horrible. Start putting money aside so you can get a good reliable car with good gas mileage.

It doesn't help that hardly a week goes by without another story about alleged TSA pilferage making headlines. Last time I went to Vegas I had my luggage inspected and I came home to find I didn't find my blood sugar tester. Good thing my insurance allowed me to get a replacement for free but I lost all those numbers.

If you have to check a bag, you can buy TSA-approved locks that can be opened by TSA if necessary. That way if anything is taken, you know it was one of them that took it, and not a baggage handler (as if that matters).



You can also take pictures of the stuff in your bags as evidence.



Again - don't know what good it will do if something goes missing...

When my wife did her annual trips to MS to visit her brother, she always sent her luggage ahead via UPS. Of course, it got shipped to her brother's house and she made sure she sent it out some good time in advance, but I didn't mind spending the extra to get it there.



When she used to fly Northwest Disorient her luggage would get to Logan before she did, because the luggage went a different flight.

I loves yous guys. Shouldn't be too bad, I'll only be there Friday and Saturday -heading home on Sunday morning - so I don't have to go to church with my Mom

But the traumatic part of the trip is that I am leaving my boyz (doggies) at my folks place in Jamestown for summer camp - my folks live on a farm 160+ acres so the boyz can run wild, but I will surely miss them, especially at night - they sleep with me - I guess Momma is not the only freak who sleeps with her pets I'll pick them up at the end of July - another road trip - ugh !

I figure it will take about a week to build it and get it tuned up, just in time for its first "broadcast", Mama returning to the SMS (unfortunately delayed), playing on a radio older than she is.

In a new TV ad launched today, Republican John McCain compares his plan to make the country energy independent by 2025 to the President John F. Kennedy's race to the moon.



McCain has been on the hustings for days now, promoting his proposals for conservation, offshore oil drilling, nuclear power, and other initiatives to wean America off foreign oil. He calls it the "Lexington Project," a reference to the Revolutionary War battle in Massachusetts. At the same time, he has been deriding Democrat Barack Obama as "Dr. No" -- opposed to any major plan for energy independence, though Obama is pushing a plan to invest $150 billion over 10 years on alternative energy.



"American technology protected the world," the announcer says in the ad, which is to air on national cable and in undisclosed battleground states. "We went to the moon, not because it was easy, but because it was hard.



"John McCain will call America to our next national purpose: Energy Security," the narrator continues. "A comprehensive bipartisan plan to: Lower prices at the pump. Reduce dependence on foreign oil through domestic drilling. And champion energy alternatives for better choices and lower costs. Putting country first. McCain."



Trying to appeal to independent voters, the ad never mentions that McCain is a Republican and highlights his bipartisan streak.







The hell of it is, he may be right. We can do this, but it's going to take everyone working for the same goal. Without government interference and oil profiteering, of course.

Our News 12 channels have been using robo-cans for a couple of years now. It seems to become the standard in the industry with the hope that auromation will reduce the staffing needs so that they can get by on fewer people. Of course in some situations like where I work, keeping the staffing needs to a minimum has resulted in a few problems because when one person is sometimes covering two rooms which may create a situation should any problem arise.



I like the weather crack. It even extends all the way down to Long Island.

Many years ago I was in the hospital for an injury - the kid in full traction in the bed across from me was under 18, played HS football and was in good shape.



Well, he told everybody he was injured playing ball? The truth was he got up to change the channel (back before remotes were common) and his back went out.

Let me preface this with these facts. I have 2 sisters. both have children, 1 with a second on the way. I am the only sister who has been married. I have been divorced, and am now happily married to the right man, BobR.



Oma is doing great. I asked her how she felt about having a 3rd great grandchild. she said mfff. I said why? this is great! She reminded me that I didn't give her a great grandchild. It has been a 20 year conversation between her and I. She doesn't want to accept the reality that motherhood is not a part of the story of my life. I told her that 'actually, I paid sisterlove to have a second child for me'. that now she can say she has three grandaughters and three G'grandchildren. I told her to ask sister (in the room) she did, Sister laughed and said 'Yeah. how the hell do you think I can afford this kid'.. Oma sounded flustered, but laughing deeply...



Then Sisah reminded Oma that at least Raine is married! so I told Oma that I got marreid not once but twice for her (two can play the guilt game) , and since sistah love #2 has not been married either, I would get married again a THIRD time just so she can say she has experienced three marriages with her grandaughters, and the great grandchildren. Oma laughed so hard, she told me she was happy she had "depends™"

Senate Holds Off on FISA



CQ ($$) reports that the Senate will take up a rewrite of the Foreign Intelligence Surveillance Act (FISA) after returning from the July 4th recess on July 8th. On June 25 the Senate voted 80-15, to limit debate on a motion to proceed to the bill (HR 6304).



Those who oppose the bill argue that the privacy of U.S. citizens would be jeopardized and the administration's warrantless surveillance program would be protected from any determination of illegality. During debate, Senator Chris Dodd☼ (D-CT) said; "we are about to make another great error because of fear, because we fail to understand that balancing legitimate interests of our security and our rights ought not to be compromised. That is what the FISA courts were created to do - to balance rights and fears over legitimate concerns about our security being jeopardized. So I rise once again to voice my strong opposition to the misguided FISA legislation before us, as it will come in the next day or so."



When the bill is considered in July, three amendments will be considered :





An amendment offered by Senators Dodd, Russ Feingold (D-WI) and Patrick Leahy (D-VT) would strip the bill of its immunity provision.

An amendment offered by Senator Arlen Specter,☼ (R-PA) would require the lawsuits' dismissal unless a federal district court determines the assistance "was provided in connection with an intelligence activity that violated the Constitution of the United States."



Senator Jeff Bingaman☼ (D-NM) plans to offer an amendment that would stay all the pending lawsuits until 90 days after Congress receives the inspectors general report on the president's surveillance program required by the legislation.

A gustnado is a colloquial expression for a type of short-lived, shallow, cyclonic circulation that can form in a severe thunderstorm. While it derives its name from the tornado, it has little in common with tornadoes structurally in terms of vertical development, or in regard to intensity, longevity, and formative process (classic tornadoes are associated with mesocyclones).



The average gustnado lasts a few seconds to a few minutes, although there can be several generations and simultaneous swarms. Most have the winds of an F0 or F1 tornado, and are commonly mistaken for tornadoes. However, unlike tornadoes, the rotating column of air in a gustnado usually does not extend all the way to the base of the thundercloud. Gustnadoes actually have more in common with whirlwinds (which include dust devils, whirlwinds that form due to superheated surface layers and stretched vorticity, most commonly on sunny, warm days with light winds). They are not considered true tornadoes (unless they connect the surface to the ambient cloud base) by most meteorologists and are not included in tornado statistics. Sometimes referred to as spin-up tornadoes, that term more correctly describes the rare tornadic gustnado that connects the surface to the ambient clouded base, or to relatively brief tornadoes associated with a mesovortex.



The most common setting for a gustnado is on the outflow from a severe thunderstorm (58+ mph winds). They are triggered by gust fronts (hence the name) in thunderstorms. The cool air in the gust front acts like a mesoscale cold front, it slices under the warm air ahead of it, creating upward motions and turbulent interactions. The friction from this interaction creates a spinning column of air, or eddy, which can create a gustnado (to get the general idea of this, picture an area of leaves swirling on a windy day, just on a much larger scale).



In addition to forming on the leading edge of a thunderstorm, which in a supercell is the front-flank downdraft, gustnadoes are also not uncommon in the rear-flank downdraft of supercells. This region often contains high vorticity air, and sometimes highly buoyant air, both of which are conducive to the formation of gustnadoes as well as tornadoes. Gustnadoes near the updraft-downdraft interface may evolve into bona fide tornadoes when ingested into a mesocyclone.



Although "gustnado" has yet to enter accepted weather nomenclature, the term is popular in the Great Plains and Midwest of the United States, where the phenomenon is most common.

Evidence connects child's murder to another man







A man accused of raping and killing an 11-year-old girl on Halloween night of 2005 has been cleared—for now—after DNA found on the victim's body was linked to another man.



Robert Gonzales, 22, confessed to murdering Victoria Sandoval and then later recanted that confession.



Gonzales, who is mentally disabled, initially told investigators he strangled Sandoval, whom he considered his girlfriend, after she told him her real age. The man said he was upset because he thought Sandoval was 14.



This week, the case against Gonzales took an abrupt turn when investigators linked DNA found at the scene to another man, 20-year-old Israel Diaz.



Diaz, an illegal immigrant, was picked up on a burglary charge in April and was about to be deported to Mexico. He is now being held by the federal government, but officials in New Mexico are doing paperwork to get him into state custody so Diaz can be charged with murder.



Jeff Buckels, Gonzales' attorney, said Friday was an emotional day for his client and family.



"Sometimes things just aren't the way they seem at first glance, and sometimes—especially vulnerable people like Robert Gonzales—will actually confess to something they didn't do."



However, the district attorney's office isn't ready to say Gonzales is in the clear. Kari Brandenburg says there is evidence another person was involved in the killing.



Brandenburg's office dropped charges against Gonzales without prejudice, meaning they can be re-filed.

Actually it sounded WAY worse than I meant for it to. I have friends in the medical profession and they are DMAT and I think that is under FEMA but FEMA is there to preserve order, order is government authority. That is not necessarilly a bad thing. The option being anarchy in a crisis.



That is why their primary mission is to preserve authority. Order will help get the things needed to the people that need them. Medical, food and water, etc.
