When does a network become a PAC?
Author: BobR    Date: 03/01/2023 14:04:46

What is a PAC (or Super PAC)? According to the FEC website:
A Super PAC becomes a political committee once its contributions or expenditures exceed $1,000 in a calendar year. After the committee crosses that threshold, it must register within 10 days, using the Statement of Organization, Form 1. A PAC may register and begin reporting before it exceeds the $1,000 threshold.

The ongoing saga of FOX "News" and Dominion voting has provided some eye-opening looks into the inner workings of the entertainment-posing-as-news network. As Raine mentioned in her blog on Monday, pointing out the amazing story that while the on-air hosts were supporting TFG's nonsense about the election being "stolen", they were texting with each other about how it absurd it all was.

This is at the core of the defamation lawsuit: That FOX "News" knew it was lying about Dominion Voting machines being hacked. That it shows what a farce the entire network is is just bonus material.

But wait - there's more to the story. We've all considered that FN was (is) the propaganda arm of the Republican party. Another underreported and frankly quite shocking bit in the testimony by Rupert Murdoch is that they provided President Biden's campaign ads to Jared Kushner before they aired them - ostensibly so that the TFG's campaign could have a response ready to go, or even preempt Biden's ad with its own:
A new filing in Dominion's mammoth defamation lawsuit against Fox News includes claims that network chief Rupert Murdoch gave former Trump advisor Jared Kushner confidential information about Joe Biden's strategic moves in the lead-up to the 2020 election.

Dominion Voting Systems opposed Fox News' move to throw out the lawsuit in a new filing on Monday, in a high-stakes case set for an April trial. The voting company alleged through depositions, and internal texts and emails, that Murdoch provided Jared Kushner with advance knowledge of then-candidate Joe Biden's political ads and debate preparations.

"During Trump's campaign, Rupert provided Trump's son-in-law and senior advisor, Jared Kushner, with Fox confidential information about Biden's ads, along with debate strategy (providing Kushner a preview of Biden's ads before they were public)," Dominion's lawyers wrote in the filing.

Does this count as an "in kind" campaign donation to the TFG's campaign (of more than $1000.00)? Was FN acting as PAC?

I don't have an answer to those questions, but it's certainly something the FCC and SEC should be taking a look at.
